Each type of fraud requires the government to prove specific elements, and those elements vary more than most people realize.
Experience as a federal prosecutor revealed that many transactions the government investigates are not actually fraudulent under federal law. Not every interaction with a bank constitutes bank fraud, and the good-faith defense applies across all fraud charges. Identifying these nuances early is essential in developing a strong defense.
My goal is to examine every allegation in a federal indictment and evaluate whether the government can truly meet its burden of proof.
